Draft rules, working version of 23 September 2026. This text has not come into force. The basis the percentages apply to, how referrals are counted, the payment terms and the personal data notice are all still to be confirmed. Opening the WoW application does not constitute acceptance of these rules.
01Purpose and scope of the programme
The programme covers introducing to WheelOfWork an assignment opportunity, a freelancer answering an open assignment, or an assignment and a freelancer together. The referrer facilitates an introduction; WheelOfWork remains free to accept or decline the file and to conclude or not the contracts that follow.
This document is a draft set of contractual rules. It comes into force only once the parameters identified below are settled, a dated version is published, and the referrer expressly accepts that version. Visiting this page or clicking through to the application does not constitute acceptance. The contracting WheelOfWork entity and its full details will have to appear in the acceptance journey; the publisher’s information is available in the legal notice.
02Participants and independence
The referrer must have legal capacity and the right to carry on and to invoice the activity concerned. They provide the accurate information needed to identify them, to verify their situation and to pay them. The terms applying to private individuals acting outside a professional capacity are still to be defined; this version does not promise them payment without a suitable framework.
The referrer acts wholly independently, without exclusivity and without any relationship of subordination. They have no mandate to represent WheelOfWork, to negotiate or sign on its behalf, to set its prices or to commit it in its place. How the relationship is characterised in law also depends on how it is actually performed.
The referrer honours their commitments to their own clients, employers and partners. They declare any conflict of interest. No benefit may be paid in return for an unfair purchasing decision, for circumventing a procedure, or as an act of corruption. An employee or representative of the client may not receive a commission for influencing a decision that falls within their duties.
03Submitting a referral, and its types
Assignment only: presenting a concrete client requirement to be resourced, with only the information needed to qualify the requirement and to contact an authorised person.
Combo: presenting an assignment and a freelancer able to carry it out, together. The Combo rate replaces the separate assignment and freelancer rates; it is not added to them.
Freelancer for an open assignment: submitted only through the “+ Freelance” button in the open assignments table in the WoW application. A submission through any other channel does not count as an eligible referral in this category.
Submitting a referral guarantees neither that it will be qualified, nor that an assignment will start, nor a commission. Before passing on any profile or contact details, the referrer makes sure the person is informed of the introduction and agrees to it.
04Qualification, duplicates and attribution
WheelOfWork checks that the requirement is real, that the profile is relevant, that the introduction is traceable, and that it does not duplicate a file already known or active. A company name on its own, or a profile collected without permission, is not enough.
Attribution is confirmed in writing, or in a record that can be kept within the application, stating the assignment, the category of referral, the beneficiary and the rates that apply. Where referrals compete, the dated evidence and the actual contribution are examined with both sides heard; no automatic aggregation is provided for.
A refusal or a challenge to an attribution may be put to WheelOfWork with the relevant supporting evidence. It must be possible to ask for an error to be corrected. The operational arrangements and the priority rule for duplicates will have to be confirmed before the programme is switched on.
05Rates, basis and cap
The rates are those in the table below. The Tier 1 and Tier 2 uplifts are already included: they are not added a second time. The Combo rate is not the sum of the other two rates.
Commission is capped at €30 per day worked, whatever the day rate. The cap applies once the applicable rate has been determined. It also limits the effect of moving up a tier.
Proposed formula: commission excluding tax = the sum, for each eligible day, of min(daily basis excluding tax × applicable rate, €30). The basis is STILL TO BE SETTLED: the freelancer’s reference day rate, the amount invoiced to the client excluding expenses, the margin, or another contractual base. No figure in euros can be presented as earned before that choice is made.
Proposal to be settled: part days and their cap would be pro-rated; VAT, expense reimbursements and days not worked would be excluded from the basis. Credit notes or corrections to days would be handled on a documented corrective statement, without arbitrarily calling into question rights already earned.
06Progression and the applicable rate
Tier 0 — Sponsor: 0 to 2 referrals. Tier 1 — Confirmed: 3 to 7 referrals, that is +1 percentage point. Tier 2 — Elite: from 8 referrals, that is +2 points. These differences are already built into the rates.
STILL TO BE SETTLED: what counts as a referral, the period over which referrals accumulate, and the date a change of tier takes effect. A submission that has not been qualified must not be presented as progress already earned.
Proposed operation: a referral would count once an attributed assignment has actually started; a Combo would count as one referral; the count would run from joining the programme. The new rate would apply to days after the change of tier, including on assignments already running, with no retroactive effect. These arrangements are proposed and are not conditions already approved.
07How long commission runs, and the end of an assignment
An eligible referral gives rise to commission for as long as the assignment concerned runs, under the conditions of the accepted rules. An assignment that stops produces no commission on days not worked.
Extensions attached to the same assignment must be tracked in the attribution statement. A new assignment, or a separate requirement at the same client, does not automatically open a new entitlement without the corresponding referral being qualified.
Leaving the programme does not remove commission already earned. Assignments still running continue to be handled under the version accepted, subject to the legally justified consequences of fraud or of a breach directly connected to the referral.
08Statements, invoicing and payment
A statement must let the referrer understand, for each assignment, the days counted, the basis, the tier, the rate, how the cap was applied and any adjustments. Invoicing documents and bank details are sent through the secure channels WheelOfWork provides.
STILL TO BE SETTLED: the event that gives rise to the entitlement, how often statements are issued, whether payment is linked to the client having paid, and the payment period. No immediate, automatic or guaranteed payment is announced in this version.
Proposed operation: a monthly statement of validated days, then payment within 30 days of a compliant invoice being issued, with no condition of the client having paid added by implication. The periods adopted will have to comply with the mandatory provisions that apply. Late payment interest and, between businesses where that legislation applies, the statutory fixed recovery charge appear in the final conditions and on invoices.
The referrer remains responsible for their own tax, social security and invoicing obligations. Commissions are stated excluding tax; VAT is added only where it is legally due. An incomplete file must be the subject of a reasoned request to put it right, not an automatic loss of entitlement.
09Confidentiality and fair dealing
Each party protects the non-public information it receives for the introduction. The referrer passes on no trade secret, no document belonging to a third party without permission, and no information obtained unlawfully.
Information is used only to qualify and carry out the introduction and the commitments attached to it. No logo, testimonial or client reference may be used to announce a partnership without the agreement of the party concerned. Confidentiality obligations continue for as long as the information remains confidential, subject to disclosures required by law.
10Protection of personal data
Under the arrangement proposed, WheelOfWork determines the purposes of qualifying referrals, tracking assignments, calculating commission and preventing fraud. The referrer’s data needed to join is processed to perform the contract or to take pre-contractual steps; invoicing also falls under legal obligations. Qualifying business contacts, and security, may rest on a legitimate interest in keeping a record, while respecting those people’s rights.
Only the business contact details that are of use, the elements of the requirement, the relevant skills and availability, the reference of the submission and the data needed for tracking and payment should be passed on. No bulk contact file, health data, freelancer identity document or data unrelated to the assignment should be submitted at this stage.
The referrer informs the person of WheelOfWork’s identity, of the purpose of the introduction and of the transfer envisaged. They obtain the person’s prior agreement to their profile being presented, and keep something that evidences it. Agreement to an introduction is not blanket consent to any prospecting or re-use.
Where data is collected indirectly, WheelOfWork provides the information required by Article 14 of the GDPR within the applicable period, and at the latest at the first contact or at the first disclosure to another recipient if that comes sooner, save for a legally justified exception. The referrer does not take that obligation on in its place.
Access must be limited to authorised teams, to the service providers required, and to the authorised contacts for the assignment. The actual recipients, the processors, the retention periods and any transfers outside the European Economic Area must be set out in the application’s notice before the programme is switched on. The showcase site’s notice must not be presented as covering these processing operations on its own.
Depending on the processing, people have rights of access, rectification, erasure, restriction, objection and portability, and the right to withdraw consent where consent is the legal basis. They can write to dpo@wheelofwork.com and lodge a complaint with the CNIL. Withdrawal of a profile must be passed to WheelOfWork without delay; what is needed to meet a legal obligation or to defend a right may be archived with restricted access.
11Liability, suspension and changes
WheelOfWork does not guarantee that a freelancer will be selected, nor the signature, length or volume of an assignment, before these are confirmed contractually. Each party answers for its own breaches under the applicable law. No clause deprives a party of a mandatory right, or excludes a liability that cannot lawfully be excluded.
A documented suspicion of fraud, corruption, a false profile or an unlawful transfer may justify a proportionate suspension, notice to the referrer, and consideration of their observations. A suspension is not an automatic forfeiture of commission unconnected with the breach.
Any new version must be dated, accessible and accepted for the new commitments concerned. A change does not retroactively reduce commission already earned, or rights attached to an assignment already accepted. The referrer may stop taking part, subject to commitments under way.
12Complaints, evidence and governing law
For any question or dispute, write to hello@wheelofwork.com with the reference of the referral and the relevant details. The parties look first for an amicable solution, without depriving anyone of a remedy or automatically suspending a statutory time limit.
Records of submissions, confirmations, accepted versions and statements kept on a durable medium are evidence that can be discussed and added to. The mechanism for accepting and retaining versions has to be put in place in the application; it is not switched on by this page.
The final rules will be governed by French law, subject to the mandatory provisions that apply. Failing an amicable agreement, jurisdiction is determined by the legal rules, with no blanket attribution to a single court for all participants.
